Navistar Bonus Practices: Are They Confusing?

Did Navistar Hide the Ball? Recently, Navistar was sued for not paying a bonus based on its sales performance. Judge Flynn stated that Navistar "could do a much better job of drafting documents" explaining the incentive plan. Judge Flynn concluded that Navistar should conduct "a careful review of" its incentive plan and consider the "rewriting of its employment letters." Vukotich v. International Truck and Engine, No. 00 L 009269 (Dec. 18, 2001).

Has Navistar followed Judge Flynn's advice? If not, are new Navistar hires aware that individual performance is a factor in determining the amount of bonus, if any, under the incentive plan?
