Employers who dodge their responsibility to pay overtime to their workers often give their employees titles of “manager” or “assistant manager.” These titles mean nothing unless the employee is really a manager (‘executive’) under the Fair Labor Standards Act (“FLSA”) or Illinois overtime laws. The definition of manager is a bit complicated but generally speaking an employee with the title of manager is exempt from overtime only if he or she is paid on a salary basis and (1) regularly supervises two or more other employees, (2) management is the primary duty of the position, and (3) is responsible for hiring, firing, promotions, or assignments.
