Severance pay is not mandatory unless the employer has a severance welfare plan. However, for non-exempt employees, unpaid overtime, or failure to pay time and one half, can motivate employers to offer severance pay to get a release of overtime rights. In return, the employee signs a general release. This means that the employee releases all rights against the employer, including overtime under federal and State of Illinois law.
