Employers often play the following tricks to steal overtime pay from employees:
- Pay cash for straight time.
- Pay straight time for hours worked as reflected on pay stubs. This is a straight forward situation because the number of overtime hours is easy to calculate based on the pay stubs.
- Pay 2/3 of the overtime hours actually worked. For example, when Joe Doe worked 61 hours within a workweek he should have been paid for 21 hours of overtime. Instead, his pay stub stated that he only worked 14 hours of overtime and he was only paid for 14 hours of overtime.
- Alter computer time records.
- Force employees to work after signing out for the day.
- Sometimes employers use a combination of these methods!
